Top industrialized countries and in particular USA always tried to have complete control over world trade organization (WTO). Although they had many success for their purpose, they are not convinced about the WTO functions and they can not tolerate critiques of their opponents in WTO, so they were looking for a way to bypass the WTO. In 2006 Japan and USA prepared an initial proposal and tried confidentially to attract other industrialized counties into their agreement. Under the cover of fighting good counterfeit, this agreement aimed to legally enforce the intellectual property rights and total control over Internet communications. They aimed for new standards and system of laws independent of existing international organizations and countries to establish a new governing body outside of the body of existing countries. All these efforts were to forcibly implement the intellectual property right and copyright law by implementing total control on the Internet as the main media for copyright infringement. This article has been written to shed some light on the issue and disclosing the hidden parts of this agreement.Keywords: Anti-Counterfeiting Trade Agreement; Copyright; Intellectual Property Right; Internet; Counterfeit Drugs.}, keywords = {}, title_fa = {معرفی معاهده‌‌ی ضد تجارت جعلی و ارتباط آن با اینترنت}, abstract_fa = {مقدمه: معاهده‌ی ضد تجارت جعلی (Anti-Counterfeiting Trade Agreement یا ACTA) معاهده‌ای است که فی مابین بسیاری از کشورهای صنعتی جهان و در رأس آن‌ها آمریکا منعقد شده است. کشورهای صنعتی بزرگ و در رأس آن‌ها آمریکا، همواره تلاش داشته‌اند کنترل این سازمان تجارت جهانی را به طور کامل در دست بگیرند. اگر چه این کشورها به میزان زیادی در این راه موفق بوده‌اند، ولی همواره از عملکرد آن و آرای مخالفان خود در مجمع سازمان ناراضی و درصدد راهی برای دور زدن این سازمان بوده‌اند. در این رابطه دو کشور آمریکا و ژاپن با تهیه‌ی پیش‌نویس اولیه‌ی ACTA از سال ۲۰۰۶ تلاش‌های محرمانه‌ی خود را جهت ایجاد استاندارد جهانی جدیدی که فراتر از قوانین سازمان‌های موجود و مستقل از قدرت کشورهای مختلف باشد، شروع کردند. این معاهده در زیر پوشش مبارزه با جعل کالا درصدد تحقق بخشیدن به حق مالکیت معنوی یا حق کپی رایت است و با این بهانه سعی در کنترل کامل ارتباطات اینترنتی دارد. در‌ واقع این سازمان سعی در ایجاد حکومتی جدید در خارج از مرز تمام کشورها، ولی حاکم بر قوانین تمام کشورهای عضو دارد؛ تا بدین وسیله بتواند کنترل کامل اینترنت را در دست بگیرد. این مقاله سعی در روشن کردن اهداف پنهان این معاهده و ارتباط آن با اینترنت دارد. واژه‌‌های کلیدی: معاهده‌ی ضد تجارت جعلی، کپی رایت، حق مالکیت معنوی، اینترنت، داروهای جعلی.}, keywords_fa = {}, url = {https://him.mui.ac.ir/article_11058.html}, eprint = {https://him.mui.ac.ir/article_11058_eea9fea2f51cc4da898bb82cb6cf5b67.pdf} }
